General Terms and Conditions (GTC) & Cancellation Policy

1. Scope of Application

These General Terms and Conditions (GTC) apply to all contracts regarding the temporary rental of apartments for accommodation concluded between SecuraReal Consult Vermietung GmbH & Co KG (hereinafter referred to as the "Accommodation Provider" or "Vienna Experience") and the guest.

2. Conclusion of Contract & Booking

The accommodation contract is concluded upon the accommodation provider's acceptance of the guest's booking. Acceptance takes place by means of a written booking confirmation (e.g., via email).
If the guest books for additional fellow travelers, they shall be liable for their contractual obligations (in particular payment) as for their own.

3. Prices, Local Tax, and Payment Terms

The prices stated at the time of booking apply. All prices are in Euros and include statutory VAT.
The statutory Vienna local tax (Ortstaxe) is included in the stated total price ..
Due date of payment: The total amount is payable immediately upon booking via credit card, bank transfer, PayPal, etc. .

4. No Right of Withdrawal under FAGG & Cancellation Policy

Information on the Right of Withdrawal: Pursuant to Section 18 (1) No. 10 of the Austrian Distance and Off-Premises Transactions Act (FAGG), services in the area of accommodation for residential purposes are not subject to a 14-day right of withdrawal if the contract provides for a specific date or period.

However, contractual cancellation by the guest is possible subject to the following cancellation terms:

Up to [14] Tage prior to the agreed arrival date, the contract may be cancelled free of charge. Any payments already made will be refunded in full.
In the event of a cancellation between [13] und [7] Tagen vor Anreise fallen Stornogebühren in Höhe von [50] % of the total price.
In the event of a later cancellation (less than [7] Tage prior to arrival) or in the event of a no-show, 100 % of the total price will be charged.
Cancellations must be made in writing (e.g., via email).

5. Arrival and Departure (Check-in / Check-out)

Check-in: The booked apartment is available on the day of arrival from 14:00 onwards (self-check-in).
Check-out: On the day of departure, the apartment must be vacated by no later than 11:00. to be vacated.
In the event of late departure, the accommodation provider reserves the right to charge a surcharge for the additional use.

6. Guest Obligations & House Rules

The apartment may only be used by the number of persons specified at the time of booking.
Parties, events, and excessive noise are strictly prohibited. The statutory quiet hours in Vienna (10:00 PM to 6:00 AM) must be observed.
In all apartments as well as throughout the entire building, there is a strict smoking ban. In the event of a violation, a special cleaning fee of at least [250,00 €] will be charged.
Pets are only permitted with prior written consent and for an additional surcharge..
The guest is liable for all damage to the inventory or the building caused by themselves or their accompanying guests.

7. Liability of the Accommodation Provider

The accommodation provider is liable for items brought onto the premises by guests only within the scope of the statutory provisions on innkeeper liability (§§ 970 et seq. of the Austrian Civil Code / ABGB).
Liability for slight negligence (with the exception of personal injury) is excluded.

8. Data Protection & Guest Registration

The accommodation provider is legally obligated (under the Austrian Registration Act / Meldegesetz) to collect certain personal data from the guest and transmit it to the competent authorities as part of the guest register. 9. Final Provisions & Jurisdiction

Austrian law shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
The place of performance and place of jurisdiction for all disputes arising from this contract shall be the competent court with subject-matter jurisdiction in Vienna.. If the guest is a consumer residing or ordinarily resident in Austria, the place of jurisdiction shall be the district in which the guest has their place of residence.
